Welcome to Winna. These Terms of Service (“Terms”) govern your use of the Winna mobile application (“App”) and related services. By using Winna, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using Winna, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Winna is a mental toughness coaching application that provides daily mental workouts, goal tracking, habit management, and AI-powered coaching features. The App is designed as a personal development tool and is not a substitute for professional mental health treatment.

3. Eligibility

You must be at least 13 years of age to use Winna. If you are under 18, you must have parental or guardian consent.

4. User Accounts & Data

Winna operates primarily as an on-device application. Your personal data (statements, goals, habits, workout history) is stored locally on your device. You are responsible for maintaining the security of your device and any backups of your data.

5. Subscriptions & Payments

Winna offers both free and premium subscription tiers. Premium subscriptions are processed through Apple's App Store and are subject to Apple's terms of service for in-app purchases.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your Apple ID account settings.
  • Refunds are handled by Apple in accordance with their refund policies.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App's systems or infrastructure
  • Use automated systems or software to extract data from the App

7. Intellectual Property

The App, including its design, code, graphics, illustrations, and content, is owned by Winna and protected by intellectual property laws. Your use of the App does not grant you ownership of any intellectual property rights in the App.

Content you create within the App (your statements, goals, journal entries) remains your intellectual property.

8. AI Features

Winna uses artificial intelligence to provide coaching suggestions, goal alignment checks, and statement refinements. These AI features are tools to assist your personal development and should not be considered professional advice. AI-generated suggestions may not always be accurate or appropriate for your specific situation.

9. Disclaimers

  • Not medical advice: Winna is a personal development tool, not a mental health treatment or medical service. If you are experiencing mental health challenges, please consult a qualified professional.
  • No guarantees: While Winna is based on proven sports psychology principles, individual results may vary. We do not guarantee specific outcomes from using the App.
  • As-is basis: The App is provided “as is” without warranties of any kind, express or implied.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Winna shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.

11. Data Loss

Since your data is stored locally on your device, Winna is not responsible for data loss resulting from device failure, app deletion, or other circumstances. We recommend enabling iCloud backup when available.

12. Modifications to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the App.

13. Termination

You may stop using Winna at any time by deleting the App. We reserve the right to suspend or terminate access for users who violate these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the appropriate courts of jurisdiction.
